The present electoral action intends to obtain the nullity of the election of Dr. Nilson Pinilla Pinilla as new Judge of the Constitutional Court for the period of 2006-2014, by means of violation of several constitutional and legal norms in which the Supreme Court of Justice has conformed the shortlist to provide the charge of Judge of the Constitutional Court, from which the Senate of the Republic chose Dr. Nilson Pinilla Pinilla for the position mentioned. Two principle reasons exist: on one hand, no woman was included on the shortlist thus violating articles 1, 2 and 6 of the Law 581 of 2000 and articles 13, 40 and 43 of the Political Constitution; on the other hand because the same list was conformed by various Supreme Court of Justice Judges in whose election participated or was competent to participate the Dr. Nilson Pinilla when still a judge of that Corporation thus violating the form in article 126 of the Political Constitution.
