Justices of the Peace and Informal justice: a conceptual approximation of their potential and their limitations
This article analyzes the reasons for the boom in informal justice in recent years within Colombia and Latin America. It shows the democratic potential of informal justice because of their participatory character that favors peace and democracy. It also examines their antidemocratic risks because they channel social demands. The article proposes to surpass an ingenuous and total acceptance of these justices and to design strategies that that deliberately fortify their democratic potential and minimize the risk. The article finishes by showing the important role that informal justice can have in the judicial system.

El artículo analiza las razones del auge de la llamada justicia informal y comunitaria en los últimos años en Colombia y América Latina. Igualmente muestra las potencialidades democráticas de esas formas de justicia ?como son su carácter participativo y consensual, que favorecen la paz y la democracia- pero también sus riesgos antidemocáticos, como la canalización de las demandas sociales. Por ello propone superar una aceptación ingenua y total de esas justicias y diseñar estrategias que deliberadamente fortalezcan sus potencialidades democráticas y minimicen sus riesgos. El texto termina mostrando el importante papel que en ese campo puede tener la justicia de paz, como institución bisagra entre la justicia estatal y la justicia puramente comunitaria.
