Intervention: Right to Education of Persons with Disabilities

Dejusticia appeared before the Constitutional Court regarding a constitutional challenge (tutela) by a student who had been granted a loan for students with disabilities, but was then denied loan forgiveness.

En nuestro concepto, el caso demuestra que el programa de préstamos del ICETEX para la promoción de la educación superior carece de ajustes razonables para personas con discapacidad, pues las condiciones de condonación de crédito que terminan imponiéndose a esta población son desiguales. Por ello consideramos que en este caso se deben interpretar las normas conforme a la Constitución para que no generen un trato desigual en contra de las personas con discapacidad y se adecuen a las necesidades específicas de la población a la que se dirige, o si es preciso, inaplicarlas. También sugerimos que se revisen integralmente las políticas de préstamos para que se hagan los ajustes razonables necesarios.

The case demonstrates the ICETEX loan programs for higher education lack reasonable adjustments for individuals with disabilities, as loan forgiveness conditions impose a greater burden on such individuals. Thus, we encourage the Court to interpret ICETEX norms in a way that does not result in discriminatory treatment of those with disabilities and addresses their specific needs. We also suggest that ICETEX revise its policies regarding loan forgiveness in order to make reasonable adjustments.
