The Guardianship Reform: Adjust or dismantle?
This article debates the three large controversies stirred up by the guardianship reform. (1) It asks in what measure guardianship has been a factor of congestion and what to do with the possible congestion that it has caused. (2) It asks in what way legal action has caused legal insecurity and has affected the court. (3) Finally it asks whether or not reform is necessary for maintaining guardianship for social rights. The article analyzes these three points and tries to review the situation and the terms of debate in respect to each issue in order to offer perspectives about a solution.

El artículo debate las tres grandes controversias suscitadas por la tutela, a saber, (i) en qué medida ella ha sido un factor de congestión y qué hacer con la posible congestión que ha provocado; (ii) en qué medida esa acción judicial ha provocado inseguridad jurídica y ha afectado la cosa juzgada, debido a la existencia de tutela contra providencias judiciales, y qué se debe hacer frente a ese fenómeno; y, (iii) finalmente, si debe o no mantenerse la tutela para los derechos sociales. El artículo analiza esos tres puntos, intentando en cada uno de ellos reseñar la situación y los términos del debate, para luego ofrecer algunas perspectivas de solución.
