Transitional and Restorative Justice: Complements and Tensions

The study explores the benefits and drawbacks of applying the framework of restorative justice as the dominant paradigm in order to address problems presented by transitional justice in Colombia. The investigation is timely as the idea that transitional processes should be founded on restorative justice is becoming increasingly popular. By exploring the original concepts of the two branches of justice, the author analyzes several complementary characteristics between the two and also analyzes the important tensions that exist between them. The findings highlights limitations that exist in the restorative justice approach as when applied to a transitional time. Ultimately, the author concludes that the processes of transitional justice, especially those in Colombia, should contain punishment for those responsible for serious human rights violations, and therefore, only they should only contemplate using restorative justice in limited situations.

El artículo busca resolver un interrogante ¿conviene o no utilizar el esquema de la justicia restaurativa como paradigma dominante para enfocar los problemas planteados por la justicia transicional en Colombia? Este interrogante es relevante ya que muchos defienden la idea de que los procesos de en curso deben fundarse en la justicia restaurativa. Para resolver esta cuestión, el texto enuncia los orígenes conceptuales y el significado de las categorías”justicia transicional” y “justicia restaurativa”. Luego estudia varias complementariedades entre una forma de justicia y otra, pero igualmente analiza las importantes tensiones que existen entre ellas, lo cual muestra que hay grandes límites para que el enfoque restaurativo sea el paradigma de justicia dominante en contextos transicionales. El documento concluye que los procesos de justicia transicional, en especial aquéllos que hayan de tener lugar en Colombia, deben contener dosis inevitables de castigo para los responsables de graves violaciones de derechos humanos y, por ende, sólo deben contemplar la posibilidad de perdones cuando éstos sean proporcionados y ?responsabilizantes.
